Terms and Conditions

By entering this site you agree to abide by the following terms and conditions of use.  The placement of an order online indicates your acceptance of these terms and conditions.

Content

Although myescape do their best to ensure the accuracy of all the information within this website, we shall not be liable for damages of any kind resulting from the use of this site.

Placing an Order

We try to make the order process as easy as possible.  Once you have found an item you wish to buy you simply click on the “add to cart” button. Once you have finished browsing and have chosen all the items you wish to buy go to the checkout. By submitting your order at the checkout you are offering to buy the goods and allowing us to use your personal details for the purpose of supplying those goods.

All orders need to have the following information: date, purchasers name, invoice address, delivery address, contact name, telephone number, product description and quantity ordered.   We will only pass your details on to the company we contract to deliver your parcel.

All online orders are confirmed by email.  We will contact you by email regarding any delivery delays or payment issues.

If you wish to cancel your order your order and you have not received a shipping confirmation email we will be able to immediately cancel your order and process a refund to your credit card or paypal account.  If you have received a shipping confirmation email then you will need to receive your order and follow the returns process.  Once we have received the returned goods, we will process a refund to either your credit card or paypal account.

Prices

All prices are shown in NZ dollars and are inclusive of GST.  You will find the purchase price of each product displayed beside its image on the product page.  We try our best to keep you informed of the current prices but occasionally these may be changed without prior notice.

Also if a product is advertised at an incorrect price due to a typographical error or a supplier error we reserve the right to refuse or cancel an order whether or not that order has been confirmed.  In such a case we will ensure you are aware of this and a full refund will be given if required.

Availability

We strive to keep the website up to date so that items on the website are in stock.  Occasionally items do sell out very quickly, when this happens we try our best to offer you alternatives or let you know when that particular item will be back in.  We realise it is frustrating when the item you want is not in stock so we are working on ways to ensure they doesn’t happen.    We do our best to deliver goods within the timeframes stated but goods are subject to availability.  Any dates we specify for delivery of goods are approximate and we will not be liable for any losses, costs, damages, charges or expenses caused by any delay.

Payment

All payments go through paypal one of the world’s most recognised and safest payment gateways.

You can pay for your myescape order using visa, mastercard or your paypal account.  We do not accept American Express.  You do not have to have a paypal account to shop at myescape, you can choose to buy as a visitor to paypal using your credit card instead.

All card payments are authorised at the point of ordering which requires the cardholders full details including date, name, address and telephone number. These must match the details registered with the card user.  The payment will be considered complete once the funds have fully cleared into myescape’s bank account.

Delivery

We have a set delivery fee of $6.50 for orders delivered to New Zealand addresses.  We do offer free delivery on orders which are over $150 in value to New Zealand customers.

We deliver parcels in New Zealand using courier post; all parcels require a signature on delivery.  We recommend you ensure someone is available to sign for the parcel at your delivery address or alternatively have the parcel delivered to a work address.

Once the parcel has been dispatched we are unable to change the address.  If the courier is unable to deliver your parcel they will leave a calling card and you will need to contact them to arrange for re-delivery.

If you live in New Zealand once your parcel is dispatched from myescape’s warehouse you should receive it within 2-5days (with the exception of offshore addresses and any unforeseeable weather or traffic delays).

If you live anywhere else in the world please allow for up to 10 days for delivery of your order.

Delivery notification

Once your parcel has been collected from our warehouse we will send you a confirmation email to let you know your parcel has been dispatched and will be delivered within the said timeframe.

You will be informed if we are experiencing any delays or are unable to fulfil your order for any reason.

If the delivery of products is delayed for any reason myescape ltd will not be liable for any loss sustained due to such delay.

In the event that the product appears to have been damaged during delivery or the quantity of product is insufficient to that ordered you must contact myescape within 7 days of delivery so that this can be investigated further.

Property

The goods you purchase will be considered your property once the full order amount has been paid to myescape.

Myescape does not authorise anyone to use its trade mark or those of its manufacturers.

Insurance

Once you receive your item you are responsible for insurance and risk.

Returns

If you find that the product you ordered is unsuitable then please let us know and we will be happy to help you choose something else.   Email us on [email protected] for assistance.

We are happy to offer a refund or exchange on any full price item returned to us in perfect sale condition within 30 days of receipt of order with proof of purchase. Sale condition means that the item has not been used or worn has tags in place and is in the original packaging.   

In the event that the product ordered appears to be damaged or faulty you can return these at anytime and myescape will provide a full refund.

With all returns we request that you advise us by email [email protected] and/or include a brief note (with order ID#) with the product that you are sending back to us.  If you would like an exchange please ensure you include the style, colour and/or size that you wish to exchange the items for in the email.

NOTE: for hygiene reasons we are unable to accept returns on any swimwear or undergarment bottoms.  This includes briefs, boxers and g-strings.

Myescape does not offer refunds or exchanges for items purchased on sale or as part of a promotion.

Complaints

We are proud to offer a fast efficient and carefree shopping experience.  So if for any reason you are not satisfied with the service you have received we would like to know about it so we can improve it in the future.  Please direct your complaints to [email protected]

Privacy Policy

At myescape we take your privacy seriously.

During the ordering process we ask you to supply the following information: name, mailing address, email address, telephone number.  We do not give your personal information to any 3rd parties except to the company which is used to deliver your parcel.

We use this information to send you the product that you have purchased, send you a confirmation email after you have purchased a product, let you know of clothes ranges and services that come in and for our own accounting, administration and marketing purposes.  At regular intervals myescape completes a statistical analysis of customer’s and the products and areas of the site they are interested in so we know what to stock more of in the future.

Upon request you can be removed from our email mailing list.  You can do this by writing to us at [email protected] or clicking on unsubscribe at the bottom of the myescape email.

Myescape is the trading name of myescape ltd which operates under NZ law.  The registered office address is: Myescape, 34a Dean St, Grey Lynn, Auckland.

Non Waiver

If at any time myescape does not enforce these terms and conditions or grants a customer time or other indulgence, myescape shall not be construed as having waived that term or condition or its right to later enforce that or any other term or condition.

Severability

Where any provision of these terms and conditions of sale is rendered void, unenforceable or otherwise ineffective by operation of law, it shall not affect the enforceability or effectiveness of any other provision in these terms and conditions.

Liability

Myescape shall not be liable in any way whatsoever to you for any loss or damage whatsoever whether direct, indirect, special, or consequential and all such liability is expressly excluded.
